Terms & Conditions

All orders for goods accepted by INeedSpex (“the vendor”) are accepted subject to the following conditions which shall form part of and govern the contract of sale.

Acceptance of goods shall be deemed to be acceptance of these conditions of sale. Any term sought to be imposed by a purchaser either in the document or otherwise that conflicts with or adds to these conditions is not accepted.

No agent or representative of the vendor has authority to vary these conditions unless accepted in writing by a director of .

1 – Customer obligation

By placing and order, and thereby indicating acceptance of these terms and conditions, the customer confirms:

a) that they are aged 18 years or over at the time of placing the order and

b) that any prescription details provided are their own, from a prescription written by a registered optician and the prescription used is less than 2 years old.

Glasses with Prescription lenses are custom manufactured and are not returnable for a refund or exchange should they not suit your requirements or if you have entered your prescription incorrectly. Please double check that you have entered your prescription correctly with the correct values. If you are unsure of any details, please contact us before placing your order.

2 – Reglazing Services

Before sending us your frames, please double check that they meet the following requirements:

Plastic frames:- there are no cracks around the rim and that the frame are not discoloured or brittle.

Metal frames:- the screws holding the lenses are not damaged and the joints are firm.

Rimless frames:- the lenses are not secured with a ‘permanent’ (i.e. non removable) nuts and bolts.
Note that we not be responsible for breakage of the frame during fitting of the lenses and will not be liable for breakage of the frame or loss of colour etc. The existing lenses are of not use to us and will be discarded unless you specifically request that they are to be returned. This request needs to be made when you place the order. We will try our best to remove the lenses without damage, but this cannot be guaranteed as some laboratories use adhesive to secure the lenses, making them liable to break during removal.

3 – Payment and Price

The vendor reserves the right to vary the quoted price for the goods by upward additions in accordance with market conditions at the date of actual supply and the purchaser shall pay such additions in addition to the quoted price. Price lists do not constitute an offer.

We cannot refund the cost to manufacture the lenses as these are custom made to your prescription. Any other orders that are custom made, such as Varifocal or non-stock items, cannot be cancelled in accordance with the EU Distance Selling Directive. However you have the right to cancel any stock single vision orders within 14 days of acceptance of payment, assuming the order has been dispatched at that time.

4 – Availability of Goods

The vendor will use its best endeavours to comply with the date named for dispatch or delivery which date is given and intended as estimate only and is not to be the essence of the contract. If owing to non-availability of the goods or any other causes beyond the vendors control, the vendor shall be unable to effect delivery here under it shall be at liberty to determine the contract or part thereof by giving notice to the purchaser.

5 – Design Variation

Whilst the vendor makes every effort to ensure that goods supplied correspond in every respect with the sample, specification or description provided as the case may be, the vendor is not responsible for minor variations in specification, in colour or other design features, and no such minor variation shall entitle the purchaser to rescind the contract or shall be the subject of any claim against the vendor by the purchaser.

6 – Claims

a) The purchaser is obliged to notify the vendor of any damaged items within 24 hours of delivery.

b) No liability for any claim for damage or in respect of goods differing in quality or description from the particulars given on the dispatch notification shall be accepted unless the vendor is notified within 24 hours of receipt of delivery and confirmed in writing by the purchaser within seven days of delivery.

7 – Guarantee

a) If the purchaser is not completely satisfied with goods supplied for whatever reason, goods may be returned to us in line with paragraph 6, for immediate replacement or refund

b) The purchaser shall, unless otherwise stated in writing, be responsible for all expenses and incidental charges incurred during the warranty period.

8 – Returned Goods

a) If the purchaser properly rejects any of the goods in accordance with the EU Distance Selling Regulations within 14 working days in writing, the purchaser shall be responsible for the cost of returning the goods.

b) If the returned goods received by the vendor are not in a condition where they can be sold as new then the vendor reserves the right to charge a minimum 15% restocking fee. Whether goods are returned in a saleable condition is to be judged by the vendor.

c) It is reasonable for the buyer to open the outer packaging and inspect the goods.

e) Business customers have no rights to returns goods under the regulation.

f) The order cancellation must be put in writing and must be forwarded to either info@ineedspex.com or sent to returns at our head office address which can be found on the “About Us” page.

g) All refunds will be processed within 14 days from when we receive notification of cancellation of the order.

h) If goods are to be credited/refunded the original carriage charge will not be refunded.

i) We cannot refund the cost to manufacture the lenses as these are custom made to your prescription. 9 – Consequential Loss

The extent of the vendors liability to the purchaser for any default or breach whatsoever or howsoever arising shall in no case exceed the invoice value of the goods and the vendor shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or any customer of the purchaser and whether direct, indirect, consequential or however else arising.

10 – Law

If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or the enforce ability of the remainder of the conditions. This contract is and shall deemed to have been made in England and shall in all respects be governed by English Law. In respect of consumer sales only, statutory rights are unaffected by these terms and condition.

Please be aware that  glazed frames are not covered by the distance selling regulations and are therefore are not automatically refundable should you not be happy with the actual frame.
